Agreeing to these Terms is mandatory for booking a charter or using our Service. Non-agreement to these Terms results in ineligibility to use the Service.
2. Service Overview
At CanvasHarvestPulse, we offer an array of high-end yacht charter services, which include, but are not limited to:
- Renting yachts on a daily basis
- Evening yacht cruises
- Corporate getaway events
- Exclusive events
- Extended charter trips
Our services are subject to vessel accessibility and weather permissibility. We reserve the right to adjust or cease our services without prior notice.
3. Booking and Reservations
3.1 Booking Process
Charter booking prerequisites include:
- Being 18 years old or more
- Submitting accurate and full details
- Paying the stipulated deposit as indicated in your booking acknowledgement
- Consenting to these Terms & Conditions
3.2 Confirmation
Confirmation of your booking is established following our receipt of the payment and a written affirmation from us. We have the right to deny service to any individual according to our judgement.
3.3 Availability
All charters depend on the availability of the vessel and acceptable weather conditions. We will attempt to honor your chosen dates and times with our best efforts.
4. Payment Terms
4.1 Pricing
All service rates are presented in € and account for all relevant taxes unless indicated otherwise. Rates are susceptible to changes without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the entire charter fee required during booking
- Final Payment: Due 48 hours in advance of the charter's start
- Incidental expenses (if applicable): Payable at the end of the charter
4.3 Payment Methods
We welcome payment via major credit cards, wire transfers, and certified checks. All payments are processed through secure, encrypted platforms.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Cancellation more than 72 hours prior to departure: Full deposit returned minus any processing costs
- Cancellation between 24-72 hours before departure: Half of the deposit returned
- Cancellation less than 24 hours before departure: Deposit is nonrefundable
5.2 Weather Cancellations
In the event that weather conditions are unsuitable as determined by our captain, we will offer you:
- A rescheduled charter for an alternative date at no extra charge
- A complete refund if rescheduling proves to be impracticable
5.3 Mechanical Issues
Should there be any mechanical issues with the designated vessel, we will aim to supply an appropriate substitute. In the absence of a substitute, a full refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All individuals on board must adhere to the following:
- Abide by all directions given by the crew
- Utilize provided safety gear as necessary
- Disclose any medical conditions that might affect their security
- Stay within allocated spaces on the vessel
6.2 Prohibited Items
Passengers are not allowed to bring the following on board:
- Containers made of glass
- Illicit substances
- Weapons or firearms
- Excessive amounts beyond reasonable personal consumption
- Pets (exemptions may apply with prior approval)
6.3 Conduct
All passengers are expected to behave respectfully. Should a passenger's conduct pose a danger to safety or disturb the enjoyment of others, we retain the right to halt the charter prematurely with no refund.
7. Liability and Insurance
7.1 Our Liability
Our accountability is confined to the fee paid for your trip. We are not responsible for personal injury due to the negligence of passengers, loss or damage to personal belongings, incidental, indirect, or punitive damages, and delays due to weather or events not within our control.
7.2 Insurance Coverage
Our operations and vessels are protected by full marine insurance. Passengers must ensure they possess travel and personal insurance.
7.3 Assumption of Risk
By participating in our charters, you recognize the inherent hazards involved in marine-related activities and accept accountability for your personal safety and well-being.
8. Modifications and Itinerary Changes
We hold the right to alter itineraries, pathways, or timetables due to weather, safety, or operational necessities. We will strive to provide alternative experiences of comparable quality.
9. Force Majeure
Any hinderances, amendments, or cancellations caused by factors beyond our control, such as extreme weather, natural disasters, governmental regulations, port closures, or vessel malfunctions, are not under our liability.
10. Privacy and Data Protection
Your personal data is managed in compliance with our Privacy Policy. Utilizing our services signals your consent to our data collection and usage as detailed in the Privacy Policy.
11. Intellectual Property
The content found on our site, inclusive of text, imagery, logos, and other visual elements, is shielded by copyright and trademark laws. The reproduction, distribution, or creation of derivative works without our express permission is prohibited.
12. Governing Law
The applicability of these Terms is dictated by the laws of France. Any disputes will be settled in the courts situated in Nice, France.
